These Terms of Service ("Terms") govern your use of VibingClips ("we", "our", "us") and any related websites, mobile apps, or services. By accessing or using VibingClips, you agree to these Terms. If you do not agree, do not use the service.

Definitions

• "Service" means the VibingClips mobile application, website, and any related features that we provide.
• "Content" means text content or other material you submit to the Service, including images that may be generated for you.
• "AI Output" means any media generated for you by the Service's AI features based on your requests.
• "You" or "User" means anyone who accesses or uses the Service.

Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use VibingClips. If you are under the age of majority in your region, you must have permission from a parent or guardian.

License to Use the Service

We grant you a limited, non-exclusive, revocable, and non-transferable license to access and use the Service for your personal, non-commercial purposes in accordance with these Terms. We may revoke this license at any time if you violate these Terms or misuse the Service.

Acceptable Use

• Do not use VibingClips in any way that violates applicable laws or these Terms.
• Do not submit Content that is unlawful, harassing, hateful, sexually explicit, exploitative, or otherwise harmful.
• Do not solicit or promote violence, self-harm, discrimination, or misinformation.
• Do not submit Content that infringes intellectual property or privacy rights.
• Do not attempt to compromise the security or integrity of the service.

AI-Generated Content

VibingClips uses AI technology to generate media based on the text content you submit. You are responsible for the text content you provide and the resulting outputs. We review requests automatically and may block or remove content that violates these Terms or our usage guidelines. You retain rights to the media created for you, but grant us the license necessary to store and display it within the service.

Content Ownership

• You retain ownership of the Content and AI Output you submit or that is generated for you.
• You represent that you have the rights and permissions necessary to submit Content and request AI Output, and that doing so does not infringe any third-party rights.
• You grant VibingClips a worldwide, non-exclusive, royalty-free, sublicensable license to host, process, reproduce, display, and distribute your Content and AI Output solely for the purpose of operating, protecting, and improving the Service.
• If you delete Content or your account, we remove the associated media according to our retention policy.

Third-Party Services

The Service may link to or integrate with third-party services, including AI providers, app stores, payment processors, or other tools. We do not control these third parties and are not responsible for their content, terms, or practices. Your use of their services is governed by their own agreements and policies.

Termination

We may suspend or terminate access if you violate these Terms or misuse the service. You may stop using VibingClips at any time by deleting your account.

Indemnification

You agree to defend, indemnify, and hold harmless VibingClips and its affiliates, officers, directors, employees, and partners from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your Content, your use of the Service, or your violation of these Terms.

Disclaimers & Limitation of Liability

VibingClips is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, secure, or error-free. To the fullest extent permitted by law, we disclaim liability for any indirect, incidental, or consequential damages arising out of your use of the Service. Without limiting the foregoing, we are not responsible for damages that may result from:

• Interruptions, outages, malicious code, technical issues, interferences, or disconnections of the Service, communications networks, or equipment for reasons beyond our control.
• Delays or unavailability due to Internet traffic, network congestion, or utility grid failures.
• Actions or omissions of third parties.
• Maintenance, updates, or improvements that affect the availability of the Service.
• Any other circumstance beyond our reasonable control.

In any case, our total liability for any claim is limited to the amount you paid us (if any) during the twelve (12) months preceding the event giving rise to the claim.

Severability & Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision under these Terms will not be considered a waiver of that right or provision.

Service Changes

We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We are not liable for any change, suspension, or discontinuance of the Service. If we release new features, they may be subject to additional terms or fees.

Changes to These Terms

We may update these Terms to reflect new features, legal requirements, or changes to the service. We will post updates here and revise the "Last updated" date. Continued use of VibingClips after a change means you accept the revised Terms.
